Terms of Sale
1. Seller
1.1. The website tellmyshop.pl ("Website") is run, and TellMyShop licences are sold, by:

("Seller", "we", "us").
LAWYER: since the Omnibus Directive, consumer pre-contract information must include a telephone number and email address. Confirm that a phone number will be published.
1.2. These Terms of Sale ("Terms") set out how we sell licences for the TellMyShop module and how we provide the Website's electronic services (account, Audit edition, newsletter, contact). The licence itself is governed by the End User Licence Agreement ("EULA").
1.3. You can read, download and print these Terms at any time at https://tellmyshop.pl/legal/terms. We also send them to you with the order confirmation (section 10.4).
2. Definitions
Terms defined in the EULA (Module, Plan, Production Domain, Development Domain, Updates Period, Licence Key, Account, Consumer, Business) have the same meaning here. In addition:

3. Who we sell to
3.1. We sell to Consumers in the European Union and to Businesses worldwide, except in countries where sanctions or our tax set-up prevent it (EXCLUDED_COUNTRIES).
3.2. Consumers have all the rights described in these Terms, including the statutory right of withdrawal (section 11) and statutory rights for non-conforming digital content (section 13).
3.3. Consumer-like Businesses (Polish sole traders, see section 2) have the same rights as Consumers regarding withdrawal (section 11), non-conformity of digital content (section 13) and unfair contract terms. The rules for Businesses in section 15 do not apply to them to the extent they conflict with those rights. At checkout you can tell us that you are buying as a sole trader for purposes that are not professional for you. LAWYER: confirm the current numbering and scope of art. 7aa and 38a PL Consumer Act and how the Seller should identify such buyers at checkout.
3.4. Businesses (other than Consumer-like Businesses) buy on the terms in section 15. They have no statutory right of withdrawal but are covered by the 30-day money-back guarantee (section 12).
3.5. You must be at least 18 years old and have full legal capacity to buy.
4. Electronic services on the Website
4.1. We provide these electronic services free of charge:
a) Website browsing: information about the Module, documentation, blog; b) Account: managing licences, domains and Development Domains, downloading the Module and Updates, invoices, Updates renewal; c) Audit edition: downloading and activating the free read-only edition of the Module (requires an Account); d) Newsletter: product news and offers, only with your separate consent; e) Contact and support by email.
4.2. The contract for the Account and the Audit edition is concluded when you create an Account, for an indefinite period. The contract for Website browsing is concluded when you open the Website and ends when you leave it. The newsletter contract is concluded when you confirm your subscription and ends when you unsubscribe.
4.3. You may delete your Account at any time in the Account settings or by email to support@tellmyshop.pl. Deleting the Account does not cancel licences already bought, but you will lose self-service access to them; we will restore access on request after verifying your identity. [Business decision: alternatively, block deletion while paid licences exist.]
4.4. We may terminate the Account contract with 14 days' notice by email for a valid reason (for example ending the Audit edition, or a change in law), or with immediate effect if you seriously breach these Terms, in particular by providing unlawful content, attacking the Website or reselling Licence Keys. Termination does not affect paid licences except under section 17 of the EULA.
4.5. You must not provide unlawful content through the Website or support channels, use the Website in a way that disrupts it, or try to access other customers' Accounts.
4.6. Risks of using online services. Using any service over the internet carries risks such as malware, phishing emails pretending to come from us, interception of unencrypted data or someone else using your password. Protect your Account with a strong unique password, keep your Licence Key private and check that emails about your licence come from @tellmyshop.pl. We never ask for your Claude password, and we never ask you to send store passwords by email. If support needs temporary access to your store, we agree a secure method with you first.
5. Technical requirements
5.1. To use the Website and Account you need: an internet connection, a current version of a common web browser with JavaScript and cookies enabled, and an active email address.
5.2. To use the Module you need:
- PrestaShop 8.1 or newer, including 9, and PHP 8.1 or newer (PrestaShop 8.0, 1.7 and older are not supported);
- PHP MIN_PHP_VERSION or newer TBC: plugin code;
- access to install modules in your store (FTP or the back office module upload);
- an outgoing HTTPS connection from your server to the licence server;
- a Claude account (a free one is enough), under your own agreement with Anthropic;
- for Claude.ai: a store reachable from the internet over HTTPS. A store on your own computer works with Claude Desktop or Claude Code.
5.3. Multistore installations are not promised to be covered by a single licence (see the EULA, section 3.4).
5.4. We recommend installing the Module on a staging copy first. Development Domains are free (EULA, section 5).
6. Products and prices
6.1. We sell the following Plans (one-time payment, perpetual licence, 12 months of Updates and email support included, unless stated otherwise):

The current prices are the ones shown on the Website and at checkout when you order. The Audit edition is free.
6.2. Prices on the Website are shown excluding VAT. Before you pay, the checkout shows the total price including VAT (if any) for your country and customer type. That total is the price you pay.
LAWYER: Directive 2011/83 art. 6(1)(e) and the PL Consumer Act require the total price including taxes before the order. Polish price-display rules (ustawa o informowaniu o cenach towarów i usług) generally require gross prices in offers addressed to consumers. Consider showing gross prices or a "price incl. VAT" line for consumers on the pricing page, not only at checkout.
6.3. VAT. We use Stripe Tax to calculate VAT:
- Consumers in the EU: VAT of the Consumer's country of residence, settled under the EU One-Stop-Shop (OSS) scheme;
- Businesses in the EU outside Poland with a valid VAT ID (checked in VIES): no VAT charged, reverse charge (art. 196 of Directive 2006/112/EC); the buyer accounts for VAT;
- Businesses in Poland: Polish VAT (23%), invoice issued through the National e-Invoice System (KSeF);
- Customers outside the EU: no EU VAT; local taxes may apply and are the buyer's responsibility unless we are required to collect them. LAWYER / tax adviser: confirm registrations needed outside the EU, e.g. UK, Switzerland, Norway.
A Business is responsible for giving a correct VAT ID. If a VAT ID turns out to be invalid, we may issue a corrected invoice with VAT.
6.4. Founders price. The Founders price is a limited launch offer for the first 100 Shop licences. The counter on the Website shows the real number of licences sold. LAWYER: if the Founders price is presented as a reduction of the Shop price, check the Omnibus rule on showing the lowest price in the 30 days before the reduction (art. 6a of Directive 98/6/EC; art. 4 ust. 2 of the Polish price information act) and whether it applies to digital content.
6.5. We may change prices. A change does not affect Orders already paid.
7. How to order
7.1. You order on the Website as follows:
- Choose a Plan (or an additional domain or renewal) and click "Buy".
- If you are not logged in, create an Account or log in.
- On our order page, review the summary, tick the required box accepting these Terms and the EULA, and, if you are a Consumer or Consumer-like Business, decide on the box about immediate delivery (section 11.4). Optionally tick the newsletter box.
- You are redirected to Stripe Checkout. Enter your billing details, and if you buy as a Business, your company name and VAT ID.
- Check the total price including VAT, then click the payment button, which states that the order involves an obligation to pay (for example "Pay AMOUNT").
TBC: website implementation. Stripe Checkout does not offer free-form checkboxes, so the consent checkboxes should be on our own order page before the redirect, with the result stored in the order record with a timestamp. Stripe's own "terms of service" consent (consent_collection) can be used in addition.
7.2. The contract is concluded when Stripe confirms your payment. We then send you the order confirmation (section 10.4).
7.3. You can correct input errors at every step before clicking the payment button, using the browser's back function or the fields on the page.
7.4. Contracts are concluded in English (on the EN Website) or Polish (on the PL Website).
8. Payment
8.1. Payment is made in advance through Stripe Checkout, by card or other methods Stripe offers in your country. Payments are processed by Stripe Payments Europe, Ltd. or another Stripe entity under its own terms. We do not receive your full card details.
8.2. Prices are charged in EUR (EN Website) or PLN (PL Website). Your bank may charge currency conversion fees.
9. Invoices
9.1. We issue an invoice for every paid Order. Invoices are available in your Account and sent by email.
9.2. Invoices for Polish Businesses are issued through KSeF using INVOICING_TOOL. TBC: accountant.
9.3. Consumers receive a receipt or invoice in line with the law. LAWYER / accountant: check whether sales of electronically supplied services to Polish consumers require a cash register (kasa fiskalna) or qualify for an exemption.
10. Delivery of digital content
10.1. After payment we deliver:
- the Licence Key, shown on the confirmation page and sent by email;
- access to download the Module in your Account.
10.2. Delivery takes place immediately after payment is confirmed, normally within a few minutes. If you do not receive the email within 24 hours, check your spam folder and contact support@tellmyshop.pl.
10.3. Updates and support are provided during the Updates Period under the EULA.
10.4. Confirmation on a durable medium. Immediately after concluding the contract, and no later than when delivery starts, we send you an email with:
- the order summary: Plan, number of domains, price including VAT, date;
- these Terms and the EULA as PDF attachments (valid on the order date);
- if you are a Consumer or Consumer-like Business: confirmation of whether you asked for immediate delivery and acknowledged the loss of the right of withdrawal (section 11.4);
- the model withdrawal form (Annex 1) and information about the 30-day money-back guarantee.
11. Right of withdrawal (Consumers and Consumer-like Businesses)
11.1. As a Consumer or Consumer-like Business you may withdraw from the contract within 14 days without giving any reason. The period starts on the day the contract is concluded (section 7.2).
11.2. To withdraw, send us a clear statement, for example by email to support@tellmyshop.pl or by post to ul. Twarda 44, 00-831 Warszawa. You may use the model form in Annex 1, but you do not have to. It is enough to send the statement before the 14-day period ends.
11.3. If you withdraw, we refund all payments within 14 days of receiving your statement, using the same payment method you used, unless you expressly agree otherwise. You bear no fees for the refund. After withdrawal you must stop using the Module and must not make it available to others; we revoke the licence and the Module returns to read-only mode.
11.4. When the right of withdrawal expires. Under art. 38 ust. 1 pkt 13 of the PL Consumer Act and art. 16(m) of Directive 2011/83/EU, the right of withdrawal from a contract for digital content not supplied on a tangible medium, for which you pay a price, expires when we have started delivery (by giving you the Licence Key or download access), if:
a) you gave your express prior consent to delivery starting before the withdrawal period ends; b) you acknowledged that you thereby lose your right of withdrawal; and c) we sent you confirmation of this on a durable medium (section 10.4).
On our order page we ask for this with the following checkbox, which is not pre-ticked:
☐ I want the licence key and the download link delivered immediately. I acknowledge that I lose my 14-day statutory right of withdrawal once delivery starts.
This does not affect the 30-day money-back guarantee.
11.5. If you do not tick the box, we still deliver immediately, and you keep your statutory right of withdrawal for 14 days. If you withdraw in that case, we refund the full price. LAWYER: decision taken: the box is optional because the 30-day guarantee covers this period anyway, and optional consent is the safer reading of "express" consent. Alternative: make the box required for immediate delivery and delay delivery for buyers who don't tick it. Please confirm.
11.6. The right of withdrawal does not apply to the free Audit edition, for which you pay no price. You may stop using it and delete your Account at any time.
12. 30-day money-back guarantee
12.1. In addition to your statutory rights, we give every Customer, Consumer or Business, a 30-day money-back guarantee ("Peace-of-mind guarantee") on every paid Order.
12.2. You may ask for a full refund for any reason within 30 days of payment, by email to support@tellmyshop.pl from the email address used for the purchase (or from the Account owner's address). We do not ask for reasons.
12.3. We refund within 14 days of your request, to the original payment method. The refund revokes the licence (or the additional domain or renewal it concerns) and the Module returns to read-only mode.
12.4. The guarantee is a voluntary commitment. It does not limit or replace your statutory rights, including the right of withdrawal and rights for non-conformity. If both apply, you can choose the one that suits you.
12.5. Details are in the Refund and Support Policy.
13. Complaints
13.1. Non-conformity of digital content (Consumers and Consumer-like Businesses). We are liable for the Module's conformity with the contract under chapter 5b of the PL Consumer Act (art. 43h and following) and Directive (EU) 2019/770. If the Module does not conform with the contract, you may ask us to bring it into conformity (for example by a fix or an Update). If we refuse, fail to do so within a reasonable time, the non-conformity persists or is serious, you may ask for a price reduction or withdraw from the contract, within the limits set by law. LAWYER: check the liability period for one-off supply with 12 months of Updates (single act vs continuous supply) and the update obligation under Directive 2019/770 art. 8(2).
13.2. Other complaints (Website, Account, Audit edition, support, Businesses' reports of errors) can be made in the same way.
13.3. Send complaints to support@tellmyshop.pl or by post to ul. Twarda 44, 00-831 Warszawa. Please include: your name and email, the Order or Licence Key prefix, a description of the problem, the PrestaShop, PHP and Module versions, and what you expect from us. This helps us respond, but a complaint without these details is still valid.
13.4. We respond to complaints within 14 days of receipt, by email (or by post, if you complained by post). If we do not respond to a Consumer's complaint in that time, the complaint is deemed accepted (art. 7a PL Consumer Act).
14. Out-of-court dispute resolution
14.1. The European Commission's Online Dispute Resolution (ODR) platform was discontinued in July 2025, so we do not link to it.
14.2. If you are a Consumer, you can use out-of-court ways of resolving complaints and pursuing claims, for example:
- in Poland: the municipal or district consumer ombudsman (miejski / powiatowy rzecznik konsumentów), the permanent consumer arbitration courts and mediation at the Voivodeship Inspectorates of Trade Inspection (WIIH), and consumer organisations; information and the list of ADR entities are published by the President of UOKiK at
https://polubowne.uokik.gov.pl; - in other EU countries: the national ADR bodies of your country and the European Consumer Centres Network (ECC-Net), which helps with cross-border disputes (in Poland: Europejskie Centrum Konsumenckie,
konsument.gov.pl).
14.3. Using these procedures is voluntary for both parties. [Business decision: state whether the Seller agrees to take part in ADR. Under the Polish ADR act the Seller must state this when rejecting a Consumer's complaint.]
15. Terms for Businesses
This section applies only to Businesses that are not Consumer-like Businesses.
15.1. No right of withdrawal. Businesses have no statutory right of withdrawal. The 30-day money-back guarantee (section 12) still applies.
15.2. Warranty and liability are governed by sections 15 and 16 of the EULA: the Module is provided "as is", statutory warranty for defects (rękojmia) is excluded, and our total liability is limited to the price paid in the last 12 months, excluding lost profits and indirect damage, except for damage caused intentionally.
15.3. A Business confirms that it buys for purposes related to its business activity and that the VAT ID provided is correct.
15.4. For agencies, the rules on domain pools and transfers to clients are in section 9 of the EULA.
15.5. If an Agency needs more than 25 domains, a white-label build or individual terms, these are agreed in a separate written agreement.
16. Personal data
We process personal data as described in the Privacy Policy. If, during support, you share personal data of your store's customers with us, the Data Processing Agreement applies.
17. Changes to these Terms
17.1. We may change these Terms for valid reasons: changes in law, changes to payment or tax providers, new products or services, changes to the Website's functions, or to make wording clearer.
17.2. We notify Account holders by email and publish the new version on the Website at least 14 days before it takes effect. LAWYER: confirm the notice period for continuing electronic services.
17.3. Orders placed before a change are governed by the Terms in force when the Order was placed. If you do not accept a change to the Account terms, you may delete your Account before it takes effect.
18. Governing law and courts
18.1. These Terms and contracts concluded under them are governed by Polish law. If you are a Consumer, this choice does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence (art. 6(2) Rome I Regulation).
18.2. Disputes with Businesses are decided by the common court competent for the Seller's registered address. Consumers may bring proceedings before the courts competent under general rules, including the courts of their country of residence.
19. Final provisions
19.1. These Terms are available in English and Polish. LAWYER: decide which version prevails; proposal: the language in which the contract was concluded.
19.2. Nothing in these Terms limits the rights of Consumers or Consumer-like Businesses under mandatory law. Any provision that would do so does not apply to them.
19.3. These Terms take effect on EFFECTIVE_DATE.
